Isaac Newton wrote the manuscript Questiones quaedam philosophicae at the very beginning of his scientific career. This small notebook thus affords rare insight into the beginnings of Newton's thought and the foundations of his subsequent intellectual development. The Questiones contains a series of entries in Newton's hand that range over many topics in science, philosophy, psychology, theology, and the foundations of mathematics. These notes, written in English, provide a very detailed picture of Newton's early interests, and record his critical appraisal (...) of contemporary issues in natural philosophy. Written predominantly in 1664-5, they give a significant perspective on Newton's thought just prior to his annus mirabilis, 1666. This volume provides a complete transcription of the Questiones, together with an 'expansion' into modern English, and a full editorial commentary on the content and significance of the notebook in the development of Newton's thought. It will be essential reading for all those interested in Newton and the intellectual foundations of science. (shrink)

This book is concerned with the relationship between semantics and surface structure and in particular with the way in which each is mapped into the other. Jim Miller argues that semantic and syntactic structure require different representations and that semantic structure is far more complex than many analysts realise. He argues further that semantic structure should be based on notions of location and movement. The need for a semantic component of greater complexity is demonstrated by an examination of prepositions, particles, (...) adverbs and verb-prefixes, and is shown to accord with cross-language and historical facts. The volume goes on to consider the sort of rules that are required to map semantic structures onto syntax. Semantics and Syntax tackles fundamental issues and draws together many of the key concepts of traditional grammar and formal linguistics. The general framework for handling syntax, semantics and morphology that it outlines is perhaps a controversial one, but it will be recognized as challenging and original. (shrink)

One of the earliest and most influential treatises on the subject of this volume is Aristotle's Categories. Aristotle's title is a form of the Greek verb for speaking against or submitting an accusation in a legal proceeding. By the time of Aristotle, it also meant: to signify or to predicate. Surprisingly, the "predicates" Aristotle talks about include not only bits of language, but also such nonlinguistic items as the color white in a body and the knowledge of grammar in a (...) man's soul. (Categories I/ii) Equally surprising are such details as Aristotle's use of the terms 'homonymy' and 'synonymy' in connection with things talked about rather than words used to talk about them. Judging from the evidence in the Organon, the Metaphysics, and elsewhere, Aristotle was both aware of and able to mark the distinction between using and men tioning words; and so we must conclude that in the Categories, he was not greatly concerned with it. For our purposes, however, it is best to treat the term 'predication' as if it were ambiguous and introduce some jargon to disambiguate it. Code, Modrak, and other authors of the essays which follow use the terms 'linguistic predication' and 'metaphysical predication' for this. (shrink)

In recent years there has been increasing concern about the various forms of abuse faced by birthing patients during labour and childbirth. Common examples include being scolded, slapped, pinched, stabbed with scissors or struck with a ruler or other instruments. This mistreatment is collectively termed obstetric violence.A growing body of literature examines legal responses to obstetric violence including the potential use of the criminal law. The present article explores whether, in South Africa, common-law crimes or statutory offences could be used (...) to prosecute healthcare workers for the range of harms falling within the broad definition of obstetric violence. It does not question whether criminal law is an appropriate response in this instance.The article concludes that existing crimes are sufficient to address obstetric violence. It is clear that the common-law crimes of crimen iniuria, assault, assault with intention to commit grievous bodily harm and the statutory offence of involuntary sterilisation, could be used to address both physical and emotional forms of obstetric violence. It is submitted that they cater adequately for the broad range of conduct that potentially falls into the definition of obstetric violence. Further research is required in this area and it may mean that prosecutorial guidelines are needed. (shrink)

We argue that Isaac Newton really is best understood as being in the tradition of the Mechanical Philosophy and, further, that Newton saw himself as being in this tradition. But the tradition as Newton understands it is not that of Robert Boyle and many others, for whom the Mechanical Philosophy was defined by contact action and a corpuscularean theory of matter. Instead, as we argue in this paper, Newton interpreted and extended the Mechanical Philosophy's slogan “matter and motion” in reference (...) to the long and distinguished tradition of mixed mathematics and the study of simple machines. The accurate pricing of securities in the capital markets depends upon the markets being both efficient and fair. In management buyout transactions (MBOs), the price bid by inside managers enhances the efficient pricing of securities but raises a reasonable doubt about the fairness to existing shareholders. This study addresses this fairness question in MBOs and offers short-term and long-term legal alternatives which allow both the efficiency and fairness criteria to be met. In the short-term the case law established in the (...) Basic v. Levinson decision for merger negotiation disclosures should be applied to MBO transactions. Over the longer horizon, legislative changes should be made to existing securities laws. Applying the investor protection principles of the 1933 and 1934 securities acts to MBO transactions will suppress the temptation of managers to extract shareholder wealth for their personal gain. Within many approaches to the interpretation of quantum mechanics, especially modal interpretations, one singles out a particular decomposition of the state vector in order to fix the properties that are well-defined for the system. We present a novel proposal for this preferred decomposition. Given a distinguished factorization of the Hilbert space, it is the decomposition that minimizes the Ingarden–Urbanik entropy from among all product decompositions with respect to the distinguished factorization. We incorporate this choice of preferred decomposition into a framework (...) for modal interpretations and investigate in detail the extent to which it provides a solution to the measurement problem and the extent to which it ensures that measurements whose outcomes are predictable with probability 1 reveal pre-existing properties of the system under investigation. All these women have seen their marriages fail. Although most of them admit they made a wrong choice, they do not necessarily portray their former husbands as unreliable characters and themselves as heroines. The life stories cannot be read from such a narrow perspective.
